BC Court of Appeal dismisses appeal of HIV-positive man convicted of aggravated assault

The BC Court of Appeal has dismissed the appeal of an HIV positive man, convicted of aggravated assault -- for having unprotected sex with five women.

Adrian Sylver Nduwayo was handed an 18-year sentence back in 2010, for the assaults against five women in Delta, Burnaby, Port Coquitlam, Langley and Surrey.

The 42-year-old learned he was HIV positive in 1996, but went on to have unprotected sex -- infecting three of the women.

In a unanimous decision, BC's highest court has rejected Nduwayo's argument the trial judge made several errors -- and that the conviction was unreasonable.

Nduwayo has been in custody since 2003 - and received 12 years credit for time served prior to 2010.
